November 29, 2007 The Court denied Defendants’ motion to stay discovery in the action and granted Plaintiffs’ motion for leave to file a First Amended Class Action Complaint, which was filed on November 29, 2007. The Amended Complaint, among other things, adds as a named plaintiff a Massachusetts resident who worked for Defendant Banc of America Investment Services, Inc. in Boston and also adds claims under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq. on behalf of the Class. The Court also denied as moot Defendants’ motions to transfer the action to Georgia and to dismiss Plaintiffs’ claims under the Massachusetts anti-discrimination statute.

Accordingly, this class action discrimination lawsuit will now proceed against Bank of America, N.A. and Banc of America Investment Services, Inc. in federal court in the District of Massachusetts.
